Title: Question?
Post by: JaseSF on January 09, 2007, 06:49:13 PM
Can we trade movies recorded from television on here?

If not, I have the following VHS I'm looking to trade well for anything interesting I don't have:

Black Cobra (1987) (Stars Fred Williamson)(VHS Commerical Master) (Recorded in SP).

I am not sure about the legal background on trading recorded shows, so ask that we please do not.

Legally speaking isn't not illegal to trade media as it is not being manufactured for redistribution i.e. bootlegging. While it is legal to make a copy of a show off the TV it is illegal to burn a copy of a disc the same show in on, blame the digital copyright laws for that confusing bit of jurisprudence.
Now being that I have a lawyer setting next to me as I type this I can tell you there is not enough disc space on the web to cover the subject completely and shed light on the gray areas of the law. It's gets into while it is legal to digital record a song off the internet via a radio feed, it is illegal to download the same song in the same quality for free using P2P software (Kazaa type stuff). As I said GRAY, very, very GRAY! Frankly I don't think that courts even know what is leagal and what isn't the the only FACT I know of is IF you are using P2P software and has over 2000 digital copyrighted files that can be downloaded from other P2P users then you're in hot water, so never have more than 1999 files in a publicly shared folder. If you have over 2000 files you are classified as a distributor of prirated media.
Oh and could go on and make it far more confusing, but I won't.
Simply said it is likely easiest to just not do it even though it not illegal, as it could allow a few technically illegal trade to slip through.
