Title: Jail
Post by: RCMerchant on May 22, 2008, 11:45:47 AM
Monday night I go to jail for 60 days.

About three years ago me and Tara's son got into it...he and I were drinking and he went apes**t and punched my ass out. A court order was put on the household ...no booze. I violated that order. So starting Monday....I do 60 in county. With goodtime It may end up being about 45 or 50.

They're giving me work release from 7:00 to 6;00.,so I will still be able to support my family.

I went to court today....thats why I'm home now....I just got back.
I don't like jail. I went in 1985 for  45 days, a second offense DUI.....which is when I decided not to drive anymore.
That may sound stupid..."Just quit drinking! Go to AA!"
Been there.AA is depressing...makes me wanna drink. My family has a long history of mental illness and alcholism.
Some take pockets full of pills. I can't.I have hepatitus. They would kill me faster then booze. I dunno. I guess 60 will get me on the wagon wether I like it or not,eh?

Ever been to jail? Food sucks.

That sucks dude!

How did they find out you violated the no booze order?

I've been to jail but only overnight and that was years ago.
I ate breakfast in the drunk tank and it was awful.

Hopefully they'll let you out on good behavior.

To quote Lawrence from the movie Office Space, "Watch out for your cornhole, Bud."

Man, that BITES.

Ronnie, you will be missed here while you are gone.  Take care and every day, try to find some dumb little story to tell us.

I cannot believe you are going to jail for 60 days for drinking in your own home (assumption on my part), but that discussion is for another day.  Suffice it to say stuff like this does not help my present cynicism with the US.

I had been drinking a few weeks ago,and a social worker stopped over and smelt (no...not the tiny tasty fish) booze on my breath. I guess the half empty bottle of whiskey sitting on the end table didn't  help my case either.

I ain't worried about getting butt plugged. I'm old and ugly...and an ornry little bastred when I have to be. This is county jail...not Jackson. I been to jail before....it's boring and I sleep alot.

I've never been to jail myself...

(okay, people, no need for the shocked looks)

My brother-in-law used to be a regular resident of the county lock-up; not for being a trouble-maker, as he is not, but he truly got hornswaggled in child support. He had a much better paying job, but he doesn't now, yet the child support is the same and takes 80% of his income or better, even though the mother gets a check from the system regardless of him paying or not.

It's a tough road, IMO, on kids. It just struck me as unfortunate to take my niece to see her father, actually step-father, and talk to him on a phone through glass. The people working at jails treat family no better than inmates; of course, these are the same people who are working in jails because they don't have the qualifications to be a cop.

It's even tougher on her, I feel, as her biological father is in prison and her only contact is through the letters he writes.

Thankfully you did get work release. Of course, it lets you support your family, but it also gets you away from jail for a good bit of the day.

Unfortunately the county I live in is quite corrupt, and inbred, and they really put the screws to my brother-in-law and family; costing him his job and effectively extorting the equivalent of a ransom that cost my sister thousands to get him out and under house arrest, wearing an ankle device.

I would tell you to give your fellow inmates that child scaring smile of yours....er...but they might like it. :buggedout:

If anyone gives you any trouble, aside from giving them Ash's phone number :teddyr:, always remember that not only are a man's testicles the way to his heart, but they are also the way to putting him on the ground.

If you can get online during work, let us know how you are doing.

Rotten new, buddy. Be good and you'll out before ya know it!

Like you said, at least it's a rural county jail and not the big city lockup. Our little county jail even has a nice picture window in front, which only occasionally has been smashed by someone not wanting to stay their full term. Usually when that happens they just go home and get picked up sitting on their front porch.

I've never been an overnight guest of the county/city myself, but when I lived in the Music City I'd sometimes get a call to come down to the jail to pick up and/or bail out a friend or two. Night Court in Nashville at two or three in the morning can be a really interesting place to visit.

Good luck man.  I've never been in jail, and I'd prefer no too, I'm too pretty!

I did a couple weeks as an experimental subject, exisiting in a dormatory with 50 other people, not allowed to do much except pee in a bottle ad have blood drawn.    But I was there voluntarily.  And got quite a lot of money out of it.  So I can't really compare

I've never been sentenced but a friend I worked with many years ago was revolving regular at the state pen (one time for breaking into the courthouse.

He would always show up at the grocery warehouse where we worked saying he was getting in shape to go back.

Stay safe in there RC !

They stayed sober, but nobody wanted to have anything to do with 'em afterwards. I never agreed with their "accept a higher power" concept myself.

I didn't know courts could force people to keep their homes dry, especially after only one fracas. I'm surprised no one in my mom's family ever had something like that levied against them.

We'll send you a Cookie-Puss cake with a file in it... or a shiv if you'd prefer.

Sorry to hear that, RC.   I've been fortunate to stay on the right side of the law - got arrested for trespassing one time and cleared it up with a single phone call to the property owner (I actually HAD permission to go in there, but the new caretaker did not know me).  But if it does help you kick the habit, maybe it will be worth it.  Take care of yourself.

I'm not as familiar with the legal system in the US, but I do spend a fair bit of time sitting in court. Any probation order I've ever seen included a ban on consuming any alcohol or non-prescription drugs. I've seen quite a few guys come in with breach of probation on top of drunk driving, assault or whatever. I just feel sorry for some of them. For every actual criminal who comes through, there's a bunch of people who just make bad choices.

Your story is a familiar one, RC. Glad they're letting you go to work. Do your time, and we'll see you back here.

Well I haven't done any jail time since I was in the military, it was a hobby of law enforcement to toss some drunken jarhead in the slammer for a night or two. Myrtle Beach use to be really bad about this, every week I was in the states I went to Myrtle Beach SC for the weekend from Onslow Beach NC ... lots of girls at Myrtle Beach, not many at Onslow as it was a Marine Base. So I go and half the time I'd get tossed in jail for something stupid, I'd bail out most of the time after a hour or so and never show for court, forfeiting my bail as a fine. You know it was a racket since the bail was often less than $50. But that's been well over 20 years ago ... it was a different world then.
I did get charged for having a DEADLY WEAPON once when I was in the Marines, it was a broom handle I used to hold my hatch back up since the lifts were broke. Oh those were the days ...

Good luck convict.  :teddyr: Remember cigarettes are the best form of money in jail. Good thing you are getting work release, at least you get a little time out of the big house.

They don't allow us to smoke in Van Buern County. THATS a REAL bummer! I do draw....which is a plus in jail. Artists in jail . People always want you to draw stupid things like Reapers and skeletons.Unicorns and roses are big too....they like to have them drawn on their mail envolopes to send to their wives or girlfreinds.

I'll lose some weight though. Van Buern County is notorious for its lousy cuisine. Dry baloney sandwhiches, cold waffles.Breaded mystery meat."Chiken fried steak" they call it.BS. It's not steak . It's some kinda tasteless soy meat product....kinda like the crap you get outta vendening machines in those phoney 'pork chop' sandwhiches.Blek.

And what we learn about this lesson is to methodically secret the bottle away always, and don't go to the door (let somebody else, or let the visitor let themselves in, or how 'bout just go the f*ck away...)

I will miss you, but will see you soon.  I know you'll be fine.  (By the time you're back you'll have cracked 500  )

Dude, the legal system in your area sucks!  when I got my second DWI, they gave me a choice between 10 days in jail or treatment.  TEN days, and they gave you 45?  I know that's not the 60 you're talking about now, but still.

I was only in jail for a day and a half.  Hated it - but I guess that's kind of the point.  It was enough to convince me to obey all traffic laws and stay off the main roads while driving drunk from then on.  Could have skipped the 3 months of treatment, which was like AA lite.  Sit in a circle - I fell sound asleep the first day while some guy was spillin' his guts about all his horrible alcohol related ordeals.  The 36 hours in jail was all that was needed.  The whole world's goin' by and I'm stuck in this room, with the pizza that I remember from elementary school.  Oh well, at least we had a puzzle!  Then we'd sit on the steel bench, which was set into the concrete floor.  We'd pound our hands on the bench twice, clap once and sing:

Buddy you're a boy make a big noise playin'
in the street gonna be a big man some day
You got mud on yo' face
You big disgrace
Kickin' your can all over the place
Singin'

We will we will rock you

And then there was the steel toilet, set into the concrete floor, out in plain view.  And the steel bunks, set into the concrete floor, with the nice 2" mattress.  The other two guys in there were a couple of the mellowest, nicest stoner dudes I ever met.  One was doing 10 days for DWI and the other was in for a few months for drug dealing.  They told me about 10 places around town to buy pot.

But you've got work release, that makes ALL the difference.  It's not really like jail at all, you're still out in the world doing what you normally do.  You just have to go sleep at the lowest rated hotel in the area.

See ya soon RC!

Once while in Charleston, WV, I just happened to be sitting in a strip club when it got raided. Turned out some of the help wasn't of age. Anyways, they took all of us to jail, even us customers. I was booked and sat there for awhile before finally being bailed out by my brother. Thankfully, he never breathed a word to my parents.

I hate that you got sixty days. Atleast you'll be out on work release though. I wish you all the luck and don't let your mind wonder too far while you're in there and you'll be fine...

Take care,

Grace

Damn RC, that's friggin' harsh. I don't blame you for disliking AA. The few people I know who went through with it all came out as self-righteous a-holes. They stayed sober, but nobody wanted to have anything to do with 'em afterwards. I never agreed with their "accept a higher power" concept myself.

That sort of reminds me of a South Park episode that mentions AA, it made a point too on how the people involved wind up becoming afraid of alcohol instead of learning the discipline to have a drink or two every now and again.  Not a bad moral.

An addiction is not something that you can lot out to one or two a day; if it was, then it wouldn't be an addiction. An addiction is something that is always with you, and if you give in to it once, then you'll give into it continually.

As the actor Richard Harris said about his conquering his own alcoholism, "I can say no to the first drink, but I cannot say no to the second".

It's not a fear of the substance, it's a fear of what one will become; and that fear is from experience.

Sounds like the South Park writer's need to cure themselves of the addiction of having their heads up their asses. If someone even had half an idea what alcoholism is like, they would never suggest that it can be controlled with discipline by only having one or two drinks a day; that is asinine and an insult.

Agree with their methods or not, AA has helped a lot of people defeat their addictions.  Is it the right way for everyone?  Of course not - there is no panacea.

But addiction is NOT about discipline.  At least not fully. For people with true, hard core addiction to alcohol, total abstinence is probably the best approach - and that's hard enough.  Tempting the demon with a drink or two now and then is very, very risky - with very destructive consequences in many cases.

Just my two cents - I don't understand why the seemingly negative "accusations" against a program that has been very successful for a large number of people.  From what I can tell, AA has a very high success rate.

Edit: Menard and I posted at pretty much the same time.

Quote

Well said.  I was thinking the same thing.

I know a guy who quit booze cold turkey in the late 70s. The way he tells the story, he was pretty much drinking himself to death at the time, and dragging his family down too. He just had a revelation one day and stopped. Had to be hospitalized, the DTs were so bad. They tried to make him drink something to ease the withdrawal, but he stuck to it, and as far as I know, he hasn't had a drink in 30 years. He must be about 60 now. Still speaks to AA groups about it. By the time I got to know him, he was already an independent businessman and mayor of a small town.

As if that isn't amazing enough, he is the exception to the saying that there's nothing worse than a reformed alcoholic. I've seen him on a few social occasions having a great time drinking water or club soda while everybody else is knocking back the beer and the rye. He'll even buy a round for the table without partaking himself. He recognizes his own vulnerability without projecting it onto other people, and he's not afraid of the booze, as someone put it. He just knows better than to touch it. You could say he respects the booze. He and alcohol have come to an understanding.

The guy is an inspiration.

Allot of it has to do with who you keep company with or how your brought up.

Some how I've never felt the need to try alcohol and have yet to even taste it, so it's hard to relate. Someone deceptively tried to slip my family rum cake. That is about as close as I've come to almost drinking. People have done some sad things attempting to persuade, influence, and even destroy family. Not that alcohol destroys family, but people try in many ways when one has certain ways. People have insulted me to my face and worst because I have no desire to drink.

That's my experience with people and alcohol.

Alcohol can lead to nothing positive in life. Even if it's just a social drink.

It doesn't mean your a better person because you don't drink. It just means you don't drink.

Best of luck.  You are an irrepressible scamp, so you'll be missed.  See you in 60 days, or slightly less.

Eh, I've been fed plenty of stuff that was almost, but not entirely, unlike food.  Don't even mention turkeyloaf (meatloaf made with turkey).  One year, our chowhall ran out of money in late August.  To make the budget stretch, they fed us meatloaf every day until October (when they got next year's budget).  Lunch and dinner for more than a month:  turkeyloaf.  It was pretty much a soggy mass of vaguely turkey-flavored hash covered with turkey gravy.

I swore if it made an appearance at breakfast, I would snap and try to destroy the messhall on the spot.  Fortunately, that never happened.

Dang, RC, that really and truly sucks.  This place won't be quite the same without you.

I was in a holding cell for 12 hours once on an unpaid ticket.  It was the Dallas county jail.  At that time Dallas was the per-capita murder capitol of the USA.  As an impressionable 20 year old being caged up with guys with visible knife scars and bullet holes cured me of my lawbreaking ways.

I've bailed friends out of drunk tanks in rural areas, though, and those jails were a lot less frightening.

I gave my baloney sandwich away to a fellow inmate, who acted like he'd won the lottery, so I can't comment on the food.

Hope the time passes quickly and you grow stronger through this ordeal.

I don't get as many opportunities to enjoy a drink as I used to, but if it's whiskey, it's gotta be Canadian whiskey.
The great thing about CR is that it not only tastes great and mixes well, but the velvet bag comes in surprisingly handy.

I also rather enjoyed Wiser's Extra Old, a nice 18-year-old oak-aged Canadian rye (but expensive). For a party situation, Alberta Premium offers a nice balance of taste and price.

Nothing wrong with Knob Hill, Elijah Craig but my beverage of choice is Maker's.  I have a cask at the distillery with my name on it. I think that means I drink to much of it.

Getting busted because some paper-shuffler smells alcohol under your breath in your very own home sounds so surreal to my European ears. Sorry to hear about that. Actually I don't know what one would have to do to get 60 days over here - probably smashing the bottle on the guy's head instead of drinking from it, feeding it to infants, or showing "Gigli" to the public...

I've never been to jail, but when I was in the sates for vacation for four weeks after graduating from high school, my former classmates placed bets on the number of days it would take to get me arrested for an alcohol related offence. No one won, I stayed out of trouble.

Title: Re: Jail
Post by: AndyC on June 03, 2008, 07:54:18 AM
It has more to do with violating a court order than with drinking specifically. I know our justice system here takes that very seriously, because a court's authority depends on people obeying orders. So when somebody breaches a probation order, the penalty can be more severe than you might expect for what actually happened.

And it is quite fair, because probation, house arrest, and such are given in lieu of more severe punishment. I saw one woman brought into court because somebody spotted her driving her mother to church while she was supposed to be confined to her home on a drug conviction. It seems like a little thing, but the judge explained to her that the conditional sentence was for her benefit, allowing her to work and take care of her mother, and making provision for grocery shopping, appointments, etc. She would otherwise spend the time in jail. These types of sentences are somewhat controversial, and when people don't abide by them, judges find it harder to justify giving them to others who might benefit. Basically, she was screwing it up for everybody.

She'd already spent a couple of weeks in jail by this time, so she was sentenced to time served on the breach and sent home to finish her original sentence.

So you see, having a drink isn't really the issue, it's disobeying the court.

It's just a shame when it happens to somebody like RC, who is certainly no criminal.

I totally agree that respecting the law and the people who represent it is crucial for any society.
However, I can't see any kind of commensurability here (might be the wrong word, and/or grammar - I had to look it up) and I think being punished in the same way for not obeying the order not to drink at home, not to drive drunk, not to start brawling when drunk, etc might screw up people's common sense.

Additionally I just plain hate this "Because I said so" - attitude - it didn't work for me as a kid neither ("Mom, can I go to the party?" - "No!" - "Why?" - "Because I said so!" - "Aha..."). Just imagine you park in a no-parking zone and get fined 10 $. You do it again and get fined 10 $ and the judge/police officer/... tells you not to do it again. You do it again and the judge fines you 10 $ for parking in the wrong place and 60 days in jail because you didn't do what he said. Well, my first thought wouldn't be "OK, you're right, I shouldn't have done it." but "Well, f**k you too".

Sorry, I got carried away a bit. Basically, I think 60 days in jail are way over the top, be it for drinking at home or drinking at home although you were told not to.

Title: Re: Jail
Post by: AndyC on June 03, 2008, 11:17:24 AM
It's a little more complicated than that. The terms of a probation order are very specific, usually related to the type of offence, and governed by law. Judges have to be able to justify them. A prohibition against all drinking, in my experience, is pretty standard, particularly in cases where alcohol is a factor.

Likewise, breach of probation is a specific offence, with a legal definition and standard penalties. The judge has some leeway, but has to apply the law in a justifiable manner.

I'll also admit that 60 days is a bit more than I've seen for a simple breach, although I'm more familiar with the Ontario justice system. Another possibility (and only RC could answer this) is that not drinking was one of the terms of a suspended sentence, and breaching that would mean serving a custodial term for the original conviction.

But regardless of whether we would all be a little more flexible and forgiving, court orders are not something people can obey or disobey as it suits them.

I think this particular penalty might seem extreme to some of us because RC is our friend, and we know him to be a pretty nice guy. I'm not sure we'd be so incensed if we didn't know him. And it's really not all that unreasonable when you consider that he is allowed to work. That might also account for the length of the sentence. Is a 60-day sentence with time off for work the same as a 30-day full-time sentence? People do get those, and suffer far worse disruption of their lives. It does sound like the judge tried to do his job with as little harm as possible.

Do I like that this happened to RC? No. From a purely personal standpoint, he doesn't deserve it. Is it reasonable from a legal point of view? I can't say for sure, but it doesn't seem particularly unreasonable.

Title: Re: Jail
Post by: frank on June 03, 2008, 12:00:52 PM

Thanks, Andy. I still agree that judges need to enforce the law, and the decisions a judge makes need to be followed. But I also still think some laws, and this one in particular, push it a little too far regarding the punishment and the penalty in the first place. To me, a total ban of alcohol to someone who violated a law while drunk would basically be the same as to forbid someone to walk anymore because he was accused of tresspassing. Meaning, you can still do whatever you want as long as you don't harm anyone or mess with society. Also, I think it's not the best way to keep people from breaking laws.  But I always have trouble with the logics of laws (independent of the country), which basically shows that I have no basis for argumantations about legal matters.

Meaning I don't know what I'm talking about...

Title: Re: Jail
Post by: AndyC on June 03, 2008, 12:41:50 PM
You would be amazed how many people wind up in court as a result of something they did while drunk. It's an activity that changes behaviour (quite seriously for some people), and it's not as necessary as walking. A court order, in many of these cases, addresses the cause of the problem, and can augment a person's willpower somewhat. This is just in general, and not specific to RC, of course.

You can't simply tell somebody to keep the peace, and then let them go home and resume an activity that alters their personality in a negative way. And you can't order moderation, particularly for someone with a drinking problem. It's all or nothing. And you have to be consistent with everybody.

The fact is a lot of people wind up in court because they made bad choices, and alcohol impairs judgement. For some people, if you don't take it away, you are just increasing their chances of coming back.

What I'm hearing from you, Frank, is that a drink now and then in your own home is no big deal. For you and me, maybe, but not for everyone. Sit in court for a day. Alcohol is a running theme.

And we do have to consider that there wouldn't be much point in putting somebody on probation if we didn't place some kind of restrictions on them. And not drinking is a minor hardship at best, not to mention one that will improve your health.

Say, does anyone know what the initials "R.C." stand for, anyway?  Let's speculate now, before he gets back.

I'm guessing "Robot Cannibal."

Royal Crown cola

goes great with Moon Pies.

It means "Royal Crown."   He's an RC Merchant.

He's a vendor of RC cola.  C'mon, guys.

(I think I remember that the R means Ronald, think he posted that once.)

I'm raising my cup of milk and chocolate chips to you, RC.

Dude, I was just thinking to myself, "I havent seen RCM around in a while..." And now, BOOM! yer in the clink! Man, that sucks.

I've never been to the big house, but Ive had a few misshaps where I COULD have gone, (mostly for trespassing, nothing big) but I never got caught. I don't plan on going to jail any time soon or EVER if I play my cards right.

Alrighty dude, I guess I'll see ya in a month or so. Take care! And remember to not take any crap from any of the loosers in there!

OK, that puts it into perspective. So, cruel and unusual punishment is more along these lines:

or perhaps

Also kind of puts Simon Cowell's comments into perspective, when he compares a performance to something on a cruise ship.

Guess I'll have to wait for next week's episode.

Not to detract too much from the video clip extravaganza, but I thought I'd quickly chime in with my best wishes to RC and as much luck as I can mentally send thousands of kilometres away.

I had a long rant in mind initially, but it took me so long to get to the end of this thread that I'll just say 'can't wait till you're back'.

Just my two cents - I don't understand why the seemingly negative "accusations" against a program that has been very successful for a large number of people.  From what I can tell, AA has a very high success rate.

Dunno, part of it might be the fact it mentions God somewhere, something that's never popular with a certain percentage of people.

Dude, RCM, do you have any cool stories to tell us?

Ramen Noodles are big in jail. You can buy them through the commisary. You soak the noodles in a large plastic cup full of steaming hot water. Wednesday is commisary day...when everyone has a 'cook-in'. Everyone is making Ramen noodles. It's real hot in the cell on muggy days. The guard walks in for a routine check-a big black guy. He says "Dam! This place smells like noodles and ass!" And leaves real quick. It was pretty funny,(to me at least.)

Otherwise it's pretty boring. Play spades alot. Read old magazines and paperbacks.Sleep on weekends. I had work release,so the weekdays go fast. They charge you $15 dollars a day on work days, and $30 for Satuerdays and Sundays. It cost me $135 dollars a week to be in County jail. You HAVE to deposit your check into the 'Inmate Account'. There they withdraw they're money, and your not allowed any money back untill you get out. You can't go anywhere once they let you out in the morning to go to work beyond your job. No gas stations, the bank,home-nowhere. If your caught you get more time. If your car is there you MUST get permission to get a small amount of cash from your account at the jail to get gas. The food is horrendous. For lunch they pack you a bag with two baloney sandwhiches and a baggie of pretzels. EVERY DAM DAY. Dinner is at 4:00. If you are still at work, like I was, you get a bag lunch for dinner. Which is...YES! Baloney sandwhichs and pretzels!!! ACK! On weekends I got hot 'food' and I use the term 'FOOD' loosley. Meatloaf looked like a dry turd ball. The mashed taters are actually boiled frozen hash browns. White bread...no butter. I ate the collard greens and veggies. To drink was colored water. Kool aid with no sugar. I kid you not. It was horrible, nasty sh1t. I lost some weight!

That's about as cool as it gets. Boring tedium.

Awesome! great to have you back!

Well, thank you. Although, it's been a few months since I came back.:tongueout:

Do I smell noodles and ass?  :tongueout:

Well, yea, i didnt expect anything to be "cool" or nuthin' i was just thinkin' maybe there was a prison fight or maybe you shared a cell with a crazy junkie or sumthin'.

Well, also,I was in a trustee/workrelease cell. Most of them are in for stuff like drunk driving, back child support and other minor offenses...usually alchohol related. All the real knuckleheads are up stairs on the Rock. So iI was lucky.

You have to pay to be in jail?

Next thing you know we'll have to pay for water.  :bouncegiggle:
You, young man, are obviously not a home owner.

What was your first clue?  :tongueout:

No...the only thing I learned in jail was that-

. JAIL SUCKS
.The american justice system is based on how much money you have that can be taken from you.I HATE LYING CHEATING JUDGES,COPS and LAWYERS. If I had my way...I WOULD declare anarchy and KILL THEM ALL.

Ah.....I am glad yer back,Ash! Yer a FREIND!
