I once worked the scene for a train vs pedestrian...not pretty.  We had bits spread over 250 feet of tracks.  This dude is lucky.

Train tracks are private property, so yep, being on them is trespassing.

I once worked the scene for a train vs pedestrian...not pretty.  We had bits spread over 250 feet of tracks.  This dude is lucky.

Train tracks are private property, so yep, being on them is trespassing.

I know, but I'm clinical and I think it's more to keep the train company from being sued. But damn, get hit by a car and then a train, cut the guy some slack, talk about adding insult to injury.

As I recall, the 'standard' payout (hush money) the train company (here at least) offered in cases like this (or the family in case the struck individual was killed, which is more common) is $50,000.  The trespassing would only be a technicality...but I cannot say (from my experience) how that plays out in the case the guy lives.

I've seen the aftermath of train vs moose. Pretty gross, but I couldn't help but think I'd like to have seen it happen. Must have been an amazing sight.
