So, I had this video up on Youtube it was Nine Inch Nails "Hand That Feeds" with clips from the movie Equilibrium.  Had it up since January of 2007, and they just NOW decided to pull it due to "copyright" disputes.  I guess whoever publishes NIN's music doesn't want fans making tributes to their songs.

They did this before years ago with another video I made, where I put the song "Wander My Friends" from Battlestar Galactica to clips from Braveheart.

I don't think freaking get it... I'm not making a profit off these things or another, and I doubt my silly little videos are hurting anyone's sales, so why the pull? 

I mean, hell, they going to pull my two other music videos next?  Maybe I should just quit working on the video I've got going now, save myself some the trouble. 

I dunno.. maybe I could try google video or some other site... any recommendations?

It just sucks, you know?  I've got all this creative energy, all these ideas, but don't have the software or technical skills to do most of them, so I focus on what little I can do with the tools available, and then this happens.

I don't have experience uploading videos or anything, but I notice there seems to really not really be much of a pattern behind what gets yanked off Youtube. I always figured if I ever made videos, I'd probably put them on Google or something, seems like better image quality too. Can't embed them on mbs and stuff though, I guess.

Unfortunately, it is not fair use - so they will get it taken down.  Prince even had a YouTube video with a baby dancing to "Let's Go Crazy" pulled for infringement.  Now, the good news is that (last I heard) a court had ruled that copyright owners must consider if something is fair use before sending a DMCA takedown notice.  Also, the mother of the baby is pursuing a court case, and Universal failed to get it dismissed.  The case will be heard in court.

Here is an interesting thing about copyright: you do not have to enforce it to be protected (unlike trademarks).  So, the studios could allow people to make mashups and fan videos.  Obviously, they need to ensure whatever is allowed is not hurting their ability to profit from the work, but a lot of dumb DMCA takedown notices are sent.  The "Let's Go Crazy" baby is one that jumped to mind.

By the way: it might not have been NIN or their record company who had the video pulled.  It could have been whoever owns the rights to "Equilibrium."  The DMCA letter should have stated who.

Actually, they specifically mentioned the audio in that video as the reason for it's pulling.  I believe it's Universal Music who owns the rights to NIN's music, as that's the account listed that the band's video for "Hand that Feeds" is posted under.

Interestingly enough, for my other video that was posted, it was Warner Bros, who said using Braveheart footage was the copyright violation.  I know mine wasn't the only one that got pulled, another fellow who did a Braveheart video to the song "Hero" (the theme from the first Spiderman film) was yanked off as well.
