LOUISVILLE, Ky. (AP) - A pregnant woman accused of raping a teenage boy she was baby sitting has agreed to surrender to police.

Bullitt County Sheriff's Department Lt. Scotty McGaha says 25-year-old Jessica Smith repeatedly raped a 15-year-old boy. His mother says she paid Smith to watch her children.

WLKY reports McGaha says the boy may be the father since the relationship was ongoing.

Smith's attorney made arrangements Wednesday for her to surrender to police Friday. She faces rape and sodomy charges.

The boy's mother says the teen now has serious mental health issues.

The boy was probably not old enough to give his consent, when he had sex with the the woman. Usually, that is the case, when rape between a woman and a teenage boy occurs. The charge of sodomy is interesting, because that is unusual.

I do hope the jury they pick is smarter than the jury which they picked in my area to try a similiar case, minus the sodomy and the pregnancy. The woman was charged with raping an underage boy, who was not old enough to give his consent. She was not only the boy's babysitter, but also a friend of the family, and the boy's teacher. And the jury found her not guilty, on the grounds that a woman cannot rape a boy, even if he is not old enough to give his consent.

The defense I would bet emphasized the aspect of "force" and "against their will". This one of the reasons many states have "statutory rape" laws, because on that she would have been much more likely to be convicted.

Well, for the record, "sodomy" means different things as far as the law is concerned.  Although, technically it refers to anal sex, "sodomy" as a criminal charge can also refer to oral sex.  (Don't ask me WHY they'd use the same word for both items, makes no damn sense to me.)

Well, for the record, "sodomy" means different things as far as the law is concerned.  Although, technically it refers to anal sex, "sodomy" as a criminal charge can also refer to oral sex.  (Don't ask me WHY they'd use the same word for both items, makes no damn sense to me.)

Any non-vaginal sex act is technically sodomy. It's originally a religious term (after "Sodom" of Sodom and Gomorrah fame).  Legally, at least in the 19th century, it was often called "the infamous crime against nature," a term that still appears in some statutes.  But not all states recognize oral sex as sodomy, and no state punishes consensual sodomy anymore.  Forcible sodomy, oral or anal, is of course a crime everywhere.

First year law students are usually given a cite to a case by more experienced student.  In that case there is a footnote that cites some of the most outrageously written old sodomy cases.

Some are written like Victorian pornography.  There is one, a rather disgusting but humorously written case about an old man who solicited oral sex with two young girls, in which the judge re-imagines the crime in graphic detail, including descriptions of the old man's "rag-like penis."  Thus began my lifelong infatuation with (the legal definition of) sodomy.
