I followed the story somewhat from over here in the states.
I really don't think it was premeditated murder; five years for manslaughter is a fairly typical sentence here.
It was a horrible situation all the way around.

All I will say is that I am sad that South Africa no longer has the death penalty.  :bluesad:

Keeping in mind that the version we get overseas is subject to heavy manipulation: his story never rang true to me.  At NO point did he behave in a way that a reasonable, responsible person would have.  I have to assume there was a lot left out in the coverage broadcast here.  Either that or South Africa is a very scary place!

In any event, he certainly sounds like an individual who needs to be kept away from endangering anyone ever again.  Anyone who responds to noises in a bathroom in the middle of the night by shooting repeatedly through a closed door - after NOT having checked to see where the other persons in the home were at the moment - is an extreme public hazard IMO.  At worst he really DID intend to murder her.  (Which makes a LOT more sense than the defence he offered)  At best we are to believe he is either terribly judgement impaired (or just plain stupid) or emotionally/psychologically severely 'off': any way you turn it, certainly ill-equipped to be running around out there with a gun!

He was cleared of murder but sentenced for "culpable homicide," which is what we in America would call "negligent homicide." I've got no opinion on whether that is the correct disposition of the case but I will say it's much easier to prove negligence than intent.

The latest on our news today is that he may serve only ten months due to a law the judge cited in the sentencing.

well his career's over anyway, regardless how much time he does inside.
